Welcome to MyCompanion.AI, a service provided by Ameri-Trex Enterprises ("Company," "we," "us," "our"). By accessing or using MyCompanion.AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not use the App.

You must be at least 18 years of age or the age of majority in your jurisdiction to use the App. The App is not intended for minors. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

You agree to use the App only for lawful purposes and in a manner that does not infringe on the rights of others. You must not:

• Inappropriate or Illegal Queries: Ask for or provide instructions for inappropriate or illegal activities, including but not limited to bomb making, drug manufacturing, or other criminal activities.
• Harmful Discussions: Engage in discussions or communications that encourage or promote harm to yourself or others, including acts of violence or self-harm.
• Intellectual Property: Commit theft of intellectual property or facilitate such theft.
• Illicit Activities: Promote or facilitate any illicit activities.
• Other Misconduct: Send unsolicited or unauthorized commercial communications, transmit malicious software, viruses, or harmful code, disrupt or interfere with the operation of the App, or impersonate any person or entity.

The information and content you provide to MyCompanion.AI, including chats and interactions, remain your responsibility. You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process this content to provide and improve the service.

We are not responsible for any content posted or shared by other users. However, we reserve the right to review, monitor, or remove any content we deem to violate these Terms or applicable laws.

Any modifications or changes made on the client side of the App—whether intentional or unintentional—are considered final and irreversible.

The Company is not responsible for any consequences resulting from such modifications, including data corruption, loss, or service disruption.

• Deletion of Data or Companions: We reserve the right to delete any data, content, or virtual companions associated with your account at our sole discretion, without prior notice or liability.
• Service Discontinuation: We may suspend, discontinue, or modify the App or any part of it at any time for any reason without prior notice. Access and Retention:</strong> You will have access to your data and virtual companions for as long as your account remains active.
• Data Retention: We retain user data for as long as necessary to provide the service or as required by applicable law. If you request deletion of your personal data, we will process your request and delete your account and associated data within 30 days, subject to any legal obligations requiring further retention.

Your privacy is important to us. Please review our Privacy Policy which explains how we collect, use, and protect your information when you use the App.

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. If you suspect any unauthorized use of your account, please notify us immediately.

We reserve the right to terminate or suspend your account at our discretion, without notice, for any violation of these Terms or applicable law. Upon termination, you must stop using the App.

The App is provided "as is" and without any warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or free from harmful components.

To the fullest extent permitted by applicable law, Ameri-Trex Enterprises shall not be liable for any indirect, incidental, special, consequential, or punitive damages; any loss of profits or revenues (whether incurred directly or indirectly); or any loss of data or goodwill, resulting from your use or inability to use the App, unauthorized access to or use of our servers and/or personal information, or the deletion of your data, content, or virtual companions, or the discontinuation of the service.

We may modify these Terms at any time by posting the revised version on the App or our website. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of the State of Utah, USA. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in the State of Utah.
